1. Agreement to Terms

By accessing or using https://www.thevoyagerpass.com (“Site”) and its services (“Services”), you agree to be bound by these Terms of Service and all policies referenced herein. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you meet this age requirement.

3. Account Registration

Account data: You provide accurate information and keep it up-to-date.
Security: You’re responsible for safeguarding your account credentials and all activity under your account, and agree to notify us immediately of unauthorized access.

4. Use of the Site

Scope: We grant a limited, non-exclusive, non-transferable license to use the Site for personal, non-commercial use.
Prohibited conduct: You agree not to:
- Use the Site illegally, fraudulently, or for harmful purposes.
- Upload viruses or harmful code.
- Harass or abuse others.
- Screen-scrape or reverse-engineer our Services.

5. User Content

Payment terms: Payment occurs at purchase. Refunds are subject to our Refund Policy (if applicable).
Auto-renewal: Memberships may auto-renew unless canceled before the renewal date.

7. Intellectual Property

Our rights: All intellectual property on the Site (text, images, logos, trademarks) is owned or licensed by us.
Your restrictions: You must not copy, distribute, modify, or create derivative works without permission.

8. Third-Party Content

We may provide links or embed third-party content. We aren’t responsible for their accuracy, practices, or your interaction with them.

9. Disclaimers & Limitation of Liability

“As is”: The Site and Services are provided without warranties of any kind.
No liability: We’re not liable for indirect, incidental, or consequential damages, including losses related to travel, data, or profits, even if advised of possibility. Our total liability is capped at the amounts you’ve paid, or $100, whichever is less.

10. Indemnification

You agree to defend, indemnify, and hold harmless Voyager Pass and its affiliates from claims arising from your breach of these Terms or your actions on the Site.

11. Termination

By you: You may deactivate your account at any time.
By us: We may suspend or terminate your access at any time for violation or legal reasons.
Survival: Sections 5 (User Content), 7 (IP), 9 (Liability), 10 (Indemnification), and 13 (General) survive termination.

12. Changes to Terms

We may revise these Terms at any time. Material changes will be posted with a new “Last Updated” date. Continued use after changes constitutes acceptance.

13. Governing Law & Dispute Resolution

Jurisdiction: These Terms are governed by Florida law without conflict of laws.
Disputes: You and we agree to resolve disputes in state or federal courts in Orange County, Florida.

14. General

Severability: If a provision is unenforceable, the remainder remains valid.
Waiver: Failure to enforce any provision isn’t waiver.
Assignment: You may not assign your rights; we may assign or transfer with notice.
